Purpose and acceptance
Clipfer is an online video studio: tools that reframe, caption, remove silences, add text overlays and create variations of videos and photos. The service is accessible from a browser, with a plan or with purchased credits.
These terms apply to anyone who creates an account or places an order, consumer or professional. They prevail over any other document.
Account
An account is required to use the service. It is personal: you are responsible for keeping your credentials confidential and for what is done from your account.
When the account is created, 10 credits are offered to try the service, with no payment method. They have no expiry date.
You can delete your account at any time from your profile: your files, projects and data are then erased, subject to legal retention obligations.
Plans
Three plans (Creator, Pro, Agency) give, every period, a number of credits, a storage space and a quota of transcription minutes. They are paid monthly or yearly; the yearly plan is discounted compared with twelve months.
The top-up pack brings 100 credits with no expiry date, on top of a plan or without one. The Enterprise plan is subject to a quote.
The prices in force, all taxes included, are those shown on the pricing page at the time of the order. The publisher may change them; a change only applies to a current plan at its renewal, after notice.
Credits
Each tool spends credits according to the length of the videos produced, every started minute counting (with a two-second tolerance), or according to the length analysed for Clipping. The scale in force is shown on the pricing page and in the software before every run.
Plan credits are reset to the included number every period and do not roll over. Pack credits and sign-up credits do not expire as long as the account exists.
A render that fails because of the service is refunded automatically in credits. Credits have no monetary value, cannot be transferred and cannot be converted into money.
Payment
Payment is made by bank card, via the provider Stripe, which alone collects and stores payment data. The publisher has no access to it.
The plan is charged at the start of each period (month or year) until it is cancelled. The pack is paid once.
If a payment fails, access to paid features may be suspended until the situation is resolved. Invoices are available from the subscription management area.
Right of withdrawal
Under the French consumer code, a consumer in principle has fourteen days to withdraw. The Clipfer service is digital content and a service performed immediately: by confirming the order, you expressly request that performance begins before the end of this period and acknowledge losing your right of withdrawal once the service is fully performed, or access to the content has begun.
You can therefore use your credits as soon as you pay. If you have used none of the plan's credits, write to contact@clipfer.com within fourteen days: the request will be reviewed case by case.
Cancellation
You can cancel your plan at any time from your account. Cancellation takes effect at the end of the current period, which remains yours and is not refunded; plan credits can be used until that date.
The publisher may suspend or close an account in case of serious breach of these terms (unlawful content, fraud, harm to the service), after notice except in an emergency.
Your content and prohibited uses
You remain the owner of the videos, photos and texts you upload and of the files produced. You grant the publisher only the licence needed to process them, store them and return them to you.
You warrant that you hold the rights to the uploaded content and to the people who appear in it, and that its use complies with the law and with the terms of the platforms where you publish it.
The following are prohibited: unlawful content, infringement of third-party rights, impersonation, and any use intended to deceive people. The Metadata Editor is meant to produce versions of content you hold the rights to, in compliance with the platforms' terms.
Availability of the service
The service is provided as is, accessible continuously except for maintenance, outage or external cause. Tools relying on providers (transcription, AI analysis, rendering) depend on their availability.
Results produced by artificial intelligence (suggested moments, texts, transcripts) are suggestions to review: the publisher guarantees neither their accuracy nor their relevance.
Liability
The publisher is bound by an obligation of means. It cannot be held liable for indirect damages, loss of income, or the use you make of the files produced, and its liability is limited, for a professional, to the amounts paid over the last twelve months.
Nothing in these terms limits the rights the law guarantees to consumers.
Changes to the terms
The publisher may change these terms. The version in force is the one published on the website, with its date; a substantial change is announced in the software before it applies.
Disputes
These terms are governed by French law. In case of difficulty, write first to contact@clipfer.com: an amicable solution is sought.
Failing that, a consumer may use, free of charge, a consumer mediator [mediator to be appointed — to be completed] or the European online dispute resolution platform. The French courts have jurisdiction.
